Every person should be able to enjoy human rights and be free from fear, regardless of their sexual orientation or gender identity. However, in many places these human rights are not recognized, and expression of one’s sexual orientation or gender identity can be isolating, embarrassing, and even dangerous.

Asylum in the Netherlands

Anyone who fears persecution, violence, or inhumane treatment in their home country—whether from the government or others—you can apply for asylum in the Netherlands. This means asking for protection and the right to live safely in another country. You have the right to a fair asylum procedure, and if your asylum request is granted, as a refugee you have rights to housing, healthcare, education, and access to the labour market.

Applying for asylum based on being LGBTIQ+

If you fear persecution in your home country because you are LGBTIQ+, you can apply for asylum in the Netherlands. You can also apply for asylum if you are persecuted because people think you are LGBTIQ+, even if you are not. If asylum is granted, you will have the right to live and work in the Netherlands.
